Notice of Amendments to the Rulebook

Following the ending of the consultation period on a number of proposed legislative changes, set out in Consultation Papers 60 and 61, the Board, after due consideration of consultees comments, approved the final version of amendments to the Rulebook as described below.

Quite a number of responses were received in relation to the proposed changes to the “residency Rule for compliance Officers” (consultation paper No.60/2009). After due consideration of the comments the DFSA decided that it would not proceed with the proposed changes to the Rule rather it would, in appropriate circumstances, give consent to suitable arrangements through the granting of relief under Article 25 of the Regulatory Law 2004. The DFSA’s approach in this regard is further explained in the Guidance under the relevant Rule.

TAKE NOTICE THAT:

The Board made the following rule-making instruments on 2nd June 2009:

• Enhancements to the Controller and Compliance Officer Provisions Rules Instrument (No. 65) 2008, to come into effect on 1 August 2009 (See CP No. 60)

• Enhancements to Client Asset Protection Provisions Rules Instrument (No. 66) 2008, to come into effect on 1 August 2009 (See CP No. 61)

The relevant Rulebook modules will be updated on the DFSA Website on the date of the coming into force of the legislation and until such time all the amendments can be viewed under the Legal Framework > Rule-making Instruments section of the DFSA Website.
